"Class action" is type of lawsuit whereby multiple injured parties are joined in a single legal action against a defendant. They are treated as "members of a class" that was injured by the defendant. If you are eligible to be treated as such, you'd receive a notice that you must either "opt in" to the class action, or "opt out" of it. For the latter type, if you don't opt-out you may lose your ability to sue separately.

My experience with such suits are that the defendant must pay through the nose to defend itself (regardless of guilt), and the attorneys on both sides take the majority of the money. Even when plaintiffs win, the attorneys make millions and each of the members of the class gets a check for $1.86. Or thereabouts.

It is a civil suit, so no criminal penalty, but a judge- or jury-awarded penalty upon satisfactory proof of liability.

However, if LH Labs is/was a separate legal entity from Light Harmonic, it would be incredibly difficult to go after Light Harmonic's assets. The best you'd probably be able to do is to go after the assets of LH Labs company officers.

    IANAL

So how would be the chances if the goal wouldn't be to get "some" money but instead for mainly "Justice" reasons.
In my case I don't expect to get back any money but I would love to see Larry nailed and not be able to run a business anymore - at least in the US.

Yeah .. most likely he starts a new one in a while under a different name in Tikka Tukka Land but at least he will be sentenced and his reputation is hopefully gone forever.

For a long time I though about fighting back and how, dDOS his website, plaster tens of hundreds of of negative reviews with bots on any reference to LH merchandise, shit on his front door but I don't have the skills to do so...except the last one.

I want larry to be aware if you mess with the bull you get the horns. I have 40 or so years left to live, a time and place will come, mark my savage east european ass.

Jarek, feel free to be shocked and suck my willy. Being employed to cover up this fraud doesn't excuse you from an ass.

I do not know whole story but just started reading the thread.. I am certain that fundraiser, LH labs are doing terrible things by not fulfilling what they promised and ought to do...

On the other hand, I personally feel that crowdfunding company is also not doing their job properly.. Couldn't they release funds gradual way such as 30% initial release, 40% when production completed and the remainder 30% get released when orders are fulfilled? If they offer systematic control over releasing funds over the stage in order to protect individuals, this kind of issues could be avoided at least great deal if not whole. Just getting whatever commission they are getting and let individuals who put trust and funded their precious money via crowdfunding platform to deal with fundraiser directly is seems just irresponsible....

No doubt. But, in the present instance it's far too many millions of dollars too late.

The problem with doling out the money in steps is alot of time that money is needed before a step can be completed. They may need that 30 percent in order to fulfill orders in the first place. Also, once the money is raised, it is theirs... if I were a campaign, I would not want the site policing how much I get and when. Also creates alot of extra work for the site, keeping track of every single campaign's every single step. I doubt they even have the resources for that. It is easier to just release the money and cut ties with that campaign for obvious reasons.

I put a notice banner up on top of the site as a public service message. Hopefully somebody on the list is a big donor to AG Xavier Becerra.

Exactly! No way that update would have come out without the threat of the pending legal action.

I also wonder if that chassis is custom for LHL or some off-the-shelf design they found from a random supplier they can get cheaply?

Doesn't look like it fits the commitments to the Wave design, specifically the "signature" materials (carbon, titanium) and there are not memory card slots (were supposed to be two). Sure there's other stuff missing as well.

    Ugh, what a continued crap-show...

The Force tells me this is bullshit / misdirection.

Fool me once (or twice, or three times), shame on you. Fool me again, shame on me.

So sad. Their first products were fantastic. Good value, great sounding.

Their AIO DAC / Headamp was a POS, even fully loaded with femtoclocks and other garbage upgrades that Gavin bambleboozed people into buying. Looking back, it obvious why these "upgrades" were offered. The final products were so bad that one guy I knew who ordered like four of them (who got an early bird deal, but who was also lazy) offloaded them to @zerodeefex so he could sell them off.

Yep. I assume this is legal precaution stuff to show that there is still intent to finish.

Locking this thread. Let's turn a page on this, unless someone can dig up a old video of Gavin peddling femtoclocks.

    @Stuff Jones:

y u dislike? I'm not trying to hide LH Labs misdeeds.

I assume the "I got ripped off" list has already been submitted to the CA AG by the folks at Computer Audiophile. I'm just sick of it. Do you really want to hear of another LH Labs Geek Wave "update" in 2026 with with yet another mock drawering of something that doesn't exist and never will exist. I certainly don't. How many more years to do have to beat the dead horse now that Larry has skipped town for a few years now? I've already done my public service message part on SBAF. What else do you want to me do to earn your un-dislike? Go to Taiwan or China and beat him up?

Hmm, it would seem that I need to eat my words. I just came from back the future in the Doctor's Tardis and found out that LH Labs did ultimately release their Geek Wave. It actually comes with a ton of new add-ons too. Here is a picture of the fully-loaded one:

No headphones or IEM are necessary. THD+N is 0.00001% or SINAD of 140db. Results per Amir, whose consciousness is retained in a computer at Starfleet HQ in San Francisco. They cleaned up their homeless problem too. Los Angeles is still a mess though. Harry Mudd's pornbots were last seen there. There have been rumors of Mudd being a time traveler from the 21st century with first name of Bill, hailing from Ohio.
